Legal Friction

Legal Friction : Law, Narrative, and Identity Politics in Biblical Israel tracks the mystery of narratives in the Hebrew Bible and their allusions to Sinai laws by highlighting intertextual allusions created by verbal resonances. While the second and the third parts of the volume illustrate allusions to Sinai narratives made by some narratives occurring in the post-Sinaitic era, twenty-three Genesis narratives are analyzed to show that the protagonists were bound by Sinai Laws before God supposedly gave them to Moses, anticipating the Book of Jubilees. Legal Friction suggests that most of Genesis was composed during or after the Babylonian exile, after the codification of most Sinai laws, which Genesis protagonists consistently violate. The fact that they are not punished for these violations implies to the exiles that the Sinai Covenant was unconditional. In addition, the author proposes that Genesis contains a hidden polemic, encouraging the Judean exiles to follow the revisions of laws of the Covenant Code by the Holiness Code and Deuteronomy. Genesis narratives, like those describing post-Sinai events, often cannot be understood properly without recognition of their allusions to biblical laws.

Thinking about Physics

Physical scientists are problem solvers. They are comfortable "doing" science: they find problems, solve them, and explain their solutions. Roger Newton believes that his fellow physicists might be too comfortable with their roles as solvers of problems. He argues that physicists should spend more time thinking about physics. If they did, he believes, they would become even more skilled at solving problems and "doing" science. As Newton points out in this thought-provoking book, problem solving is always influenced by the theoretical assumptions of the problem solver. Too often, though, he believes, physicists haven't subjected their assumptions to thorough scrutiny. Newton's goal is to provide a framework within which the fundamental theories of modem physics can be explored, interpreted, and understood. "Surely physics is more than a collection of experimental results, assembled to satisfy the curiosity of appreciative experts," Newton writes. Physics, according to Newton, has moved beyond the describing and naming of curious phenomena, which is the goal of some other branches of science. Physicists have spent a great part of the twentieth century searching for explanations of experimental findings. Newton agrees that experimental facts are vital to the study of physics, but only because they lead to the development of a theory that can explain them. Facts, he argues, should undergird theory. Newton's explanatory sweep is both broad and deep. He covers such topics as quantum mechanics, classical mechanics, field theory, thermodynamics, the role of mathematics in physics, and the concepts of probability and causality. For Newton the fundamental entity in quantum theory is the field, from which physicists can explain the particle-like and wave-like properties that are observed in experiments. He grounds his explanations in the quantum field. Although this is not designed as a standalone textbook, it is essential reading for advanced undergraduate students, graduate students, professors, and researchers. This is a clear, concise, up-to-date book about the concepts and theories that underlie the study of contemporary physics. Readers will find that they will become better-informed physicists and, therefore, better thinkers and problem solvers, too.

The Search for Lyonnesse

Although Mme de Lafayette is acknowledged as the founder of the modern novel, her precise legacy has been understood only in relation to male-authored texts. However, she wrote as a woman, addressing issues that concerned women of her day, particularly the problem of the apparent incompatibility of sexual fulfilment and the institution of marriage. This study seeks to identify how La Princesse de Clèves was interpreted by three of Mme de Lafayette's most talented women successors and to show how their more sombre and subversive view of society was mediated in works of fiction which have strong affinities with the contes de fées for which they are well known. The novels of Mlle Bernard, Mme d'Aulnoy and Mlle de La Force are significant, not simply for what they tell us about themselves as women writers but also for what they reveal about the origins of the eighteenth-century novel.

Hardy's Wessex. The landscapes that inspired a writer

This fascinating book tells the story of Thomas Hardy's Wessex. Accompanying a multi-venue exhibition, it explores Hardy's life and work. Internationally-acclaimed writer Thomas Hardy (1840-1928) is best known for his evocative depictions of the West Country landscape and its people, a region that he called 'Wessex'. What is less well-known is that this landscape also inspired him in many other aspects of his life, from campaigning for animal welfare to questioning the way society viewed women. As liminal beings, ghosts seem particularly appropriate to define, question or challenge hybrid cultures where several, seemingly irreconcilable, identities coexist. The present volume wonders how they manifest themselves in the English-speaking world, and whether there is a specifically postcolonial kind of haunting. The twenty-two articles deal with textual, translational or historical ghosts, and take us to Canada, Australia, Africa, India or the Caribbean. The process of transnationalization in Europe is reflected in the growth of transport flows and the rapid development of new infrastructure facilities. The highly transport sector confronts policy makers with pressing challenges because some major environmental problems are attached to transport. Decision making in the field of transport and the environment is very complicated because of the complexity of the infrastructures themselves and because of the involvement of local actors in the decision making process. The central task of this book is to show how regions and countries deal with this complexity and the new challenges, different ways in which three small European countries face the many uncertainties and controversies surrounding infrastructural policies. Economical constraints, institutional and cultural factors are shown to interfere with the debates on transport-issues and the environmental risks attached to them. Each case-study describes the national characteristics of the transport sector and analyses in some detail one of the major controversies which recently arised around infrastructural projects.

Beginning in the 1990s large numbers of women from Mainland China and Southeast Asia married men in Taiwan. They now number over 400,000, warranting some to call them "Taiwan's Fifth Ethnic Group". This book argues that the rise of these marriages is a gendered and relational phenomenon, linked to the forces of globalization. Traditional ideas of marriage, such as the belief that a woman "marries out" of her natal family to be dependent upon her husband and his family, and the idea that a man should "marry down" to a woman of a lesser social and economic status, have not kept pace with changes in women's educational and career opportunities. How these relationships are formed, how they impact gendered understandings of women and men, how families are constituted and relationships developed, and how they affect the children of these families and their education, are the issues explored in this book. It breaks new ground in our understanding of transnational and cross-border marriages by looking at the long-term effects of such marriages on communities, families, and individuals.

Scripture and Midrash in Judaism

The rabbis of late antiquity produced a score of exegesis of the Hebrew Scriptures of Ancient Israel ("the Old Testament"), in which they took various approaches to the study and interpretation of what they called "the written Torah". These exegesis, called collectively "Midrash", form an important part of "the oral Torah", that is, the tradition of Sinai formulated and transmitted for memorization and ultimately written down by the ancient sages in the first six centuries A.D. These three volumes present large selections of the Midrash-documents of ancient Judaism, in the translation of Jacob Neusner, who has now translated into English nearly all of the Rabbinic literature of late antiquity. The selections are organized by type, so that readers see the various ways in which, in form and in intellectual program, the documents of Midrash-compilation were formulated and set forth. In this way, the vast body of biblical exegesis put forth by Judaism in its formative age is made available to the contemporary reader.

WHY SEX MATTERS. A Darwinian Look at Human Behavior

Why are men, like other primate usually the aggressors and risk takers? Why do women typically have fewer sexual partners? Why is killing infants routine in some cultures, but forbidden in others? Why is incest everywhere taboo? Bobbi Low ranges from ancient Rome to modern America, from the Amazon to the Arctic, and from single-celled organisms to international politics to show that these and many other questions about human behavior largely come down to evolution and sex. More precisely, as she shows in this uniquely comprehensive and accessible survey of behavioral and evolutionary ecology, they come down to the basic principle that all organisms evolved to maximize their reproductive success and seek resources to do so. Low begins by reviewing the fundamental arguments and assumptions of behavioral ecology: selfish genes, conflicts of interest, and the tendency for sexes to reproduce through different behaviors. She explains why in primate species-from chimpanzees and apes to humans-males seek to spread their genes by devoting extraordinary efforts to finding mates, while females find it profitable to expend more effort on parenting. Low illustrates these sexual differences among humans by showing that in places as diverse as the parishes of nineteenth-century Sweden, the villages of seventeenth-century China, and the forests of twentieth-century Brasil, men have tended to seek power and resources, from cattle to money, to attract mates, while women have sought a secure environment for raising children. She makes it clear, however, they have not done so simply through individual efforts or in a vacuum, but that men and women act in complex ways that involve cooperation and coalition building and that are shaped by culture, technology, tradition, and the availability of resources. Low also considers how file evolutionary drive to acquire resources leads to environmental degradation and warfare and asks whether our behavior could be channeled in more constructive ways. Why Sex Matters is a compelling work of biology, sociology, and anthropology and a penetrating study of the deep motivations that underlie individual and social behavior.

Charles Darwin's Zoology Notes & Specimen Lists from H.M.S. Beagle

Two long sets of scientific notes were made by Charles Darwin during the voyage of the Beagle. Those transcribed here are concerned with natural history, and although in 1839 he drew on them quite extensively in writing his famous " Journal of Researches ", neither they nor his geology notes have previously been published. He was a superb observer, and recorded vividly and accurately his first impressions of the appearance and behaviour of the wide range of animals, from ants to ostriches, encountered during his travels. Often he performed little experiments on the creatures that he captured, and he was never happy until he had exhaustively explored the why and wherefore of every one of his observations. During the long periods on board ship, he carried out a thorough analysis of hitherto unrecognised features of the internal anatomy of a variety of marine invertebrates, and made elegant pencil drawings of them under his dissecting microscope. The volume also includes his lists of 1 500 specimens preserved in Spirits of Wine, and some 3 500 not in Spirits, with impeccably accurate cross references to the main notes. Although his notes were made strictly for his own use, and were often highly technical, they were well written throughout, and contain many highly readable passages. Only towards the very end of the voyage were his first doubts about the immutability of species consciously pressed, but here are to be found the first seeds of his theory of evolution, and of the important new fields of behavioural and ecological study of which he was one of the principal founders.

Ancient Greek by Its Translators

When not familiar with the language itself, most readers over the centuries have had access to the ancient Greek texts only or mostly through (Latin or vernacular) translations. Such an approach is not only indirect and mediated, but also distorted and even impoverishing : meaning then prevails over the linguistic form and substance of the texts themselves. What do later or modern readers read when they read translated texts written in an ancient so-called dead language ? They read a given meaning - sometimes unfaithful, often inaccurate - dictated by a genuine understanding, the blind continuation of tradition, or an untold hidden intention. The complex range of significances conveyed by meaning simultaneously reflects the time and space (called synchrony) of when and where a text has been translated, the historical learning and linguistic skills of the translators, as well as their ideas and style. As a contribution to the perennial debate about translation (mere literary transliteration vs. creative transposition), this volume aims at analyzing some striking cases of various (literary or not) texts translated from ancient Greek showing how much for the seventeenth and eighteenth centuries aesthetics and ideology matter as much as - and often even more than - rigorous philology.

Chu Teh-Chun (1920-2014) est un acteur majeur de la peinture gestuelle abstraite. Né en Chine au sein d'une famille d'amateurs d'art, il est formé à l'Académie des beaux-arts mais subit la guerre sino-japonaise, des tragédies familiales, la disparition quasi totale de ses oeuvres de jeunesse puis l'exil - en 1949 vers Taïwan et en 1955 vers Paris, où il s'installe enfin. Nourri de peinture tant classique que moderne, tant asiatique qu'occidentale, Chu formule la sensation mnésique du paysage, l'essence dynamique du geste et le surgissement de la lumière. La mise en perspective historique, au gré de parallèles, analogies et autres résonances, nous invite à cerner la singularité d'un régime abstrait sous-tendu par la logique organique du vivant, les formes et les forces de la nature, leurs phénomènes naturels, leur fluidité éruptive et leurs révolutions cosmogoniques. Car Chu s'est longtemps trouvé quelque peu en marge de son époque, en raison peut-être d'une personnalité réservée et d'un rejet de principe de toute stratégie commerciale. L'objet de cette monographie est donc, à l'aune du recul historique et du succès actuel de l'oeuvre, de qualifier certains de ses enjeux esthétiques et d'aider à dissiper quelques malentendus qui ont pu entourer sa réception. Chu Teh-Chun (1920-2014) is a major figure in the history of gestural abstract painting. Born in China into a family of art lovers, he trained at the Academy of Fine Arts in Hangzhou. Then came the Second Sino-Japanese war, family tragedy, the loss of nearly all his early work, and finally, exile-to Taiwan in 1949, then, in 1955, to Paris, where he settled. This peaceful home witnessed the emergence of his tortured abstraction, devoid of obvious geometry, in which polychrome nebulae and maelstroms clash with violent chiaroscuro effects. Atmospheric, impossible to scale, each painting is an arena into which vision is projected and submerged amid a loss of spatial and semantic bearings. Steeped in painting both classical and modern, Asian and Western, Chu's art recreates the memory of a landscape, the dynamic essence of gesture, and the brilliance of light. This study, by placing his work in its context, using parallels, analogies, and other resonances, focuses on the singularity of his approach to abstraction, underpinned by the organic logic of the living world, by natural phenomena, forms, forces, and by their eruptive fluidity and cosmogonic revolutions. For many years, Chu remained a somewhat marginal figure, perhaps because of his reserved personality and his principled rejection of commercial strategies. Making the most of historical perspective, and in light of the artist's current recognition, this monograph sets out to define some of the aesthetic themes shaping his work and to help dispel some of the misunderstandings that have surrounded its reception.

The Sound and the Fury / As I Lay Dying, William Faulkner

German-Irish Corporate Relationships

The book addresses the question of whether, in an age of internationalisation and globalisation, cultural differences are still relevant to German-Irish corporate relationships ? The first three chapters establish the theoretical framework for the analysis by exploring the notion of culture, profiling the business cultures of both countries, and examining existing approaches to the study of parent company-foreign subsidiary relationships. In the following three chapters, using interviews carried out with two sample groups (fifteen German parent companies and fourteen of their Irish operations ; seven Irish parent companies and nine of their German operations), the parent companies in both groups are examined to see whether they demonstrate characteristics which are in keeping with their national business cultures. Their foreign operations are then analysed as is the parent company-foreign subsidiary relationship to determine whether any parent company influences are visible. The general approaches adopted by the two groups of parent companies to their foreign operations are compared and contrasted. Finally differences in national attitudes and values are identified and their impact assessed.

Employment, Well-Being and Gender

This book examines welfare effects of gender-related inequalities in Korean households and labor markets. It uses subjective well-being data to show that reductions of excessive levels of working hours did improve family well-being in the past decade. Moreover, benefits from major life events like marriage can differ greatly by sex if traditional gender roles dominate and women contribute much less than men to household earnings. Furthermore, the study examines dynamics in rural East Asian economies and their impact on individual welfare outcomes. Both land redistribution and productivity-enhancing reforms are found to have been highly beneficial for Korean development. The Indonesian case study demonstrates the importance of cash-crop decisions and the growing non-farm sector for rural development.

Living in Two Worlds

This is a study of Singapore pastors' worldview & understanding of the epidemiology, symptomatology and management of possession behaviour. The pastors' accounts are compared with those from the scientific disciplines, and convergences and divergences noted. Factors shaping both the pastors' and the scientific discourses are examined. The pastors are shown to respond to competing scientific paradigms by reinforcing their two-worlds worldview. They either live mainly in the other world, or in each world at a time, or between the two worlds. Based on theological reflection focusing on epistemology, theodicy & cosmology, the author shows that the paradigm of living in both worlds simultaneously is the most appropriate pastoral response. The theological vision of the coexisting worlds and the pastoral task of unmasking and resisting evil in all its varieties and depths are then discussed.
