Western European Integration in the 1980s

The Single European Act was formally approved by the European Council in February 1986. When Maastricht hit the headlines in the early 1990s, the Single European Act instantly became history. However, it was the Single Market programme - the main content of the Single European Act - and the years of preparation leading up to it which really gave new momentum to European integration after the "Eurosclerosis" of the 1970s. The process which led to the Single European Act was never publicly discussed. The architects and initiators of the Single Market have not become household names, however, it is these protagonists and their efforts which are the subject of this book. With information gathered from extensive interviews with key players and EC documentation, the author reviews the forces behind the acceleration of European integration.

Development and Developing International and European Law

This book contains more than 40 contributions from academics, specialists and practitioners in International and European law as well as transnational constitutional law. The articles focus on recent developments in these fields and in particular on legal aspects of development. The book is dedicated to Konrad Ginther whose own academic research and work have always been devoted to new developments in international law and the shift of legal paradigms at universal and regional levels. International law in transformation and the right to (sustainable) development as a legal principle have been important aspects of his work. The contributions of his colleagues, friends and scholars, published in honour of his 65th birthday, reflect the interplay of theory, dogmatics and the practice of development in international, European and national constitutional law.

The External Relations of the European Union

The book analyses the attitudes of non-EU countries towards European integration in historical and contemporary perspectives. The authors study a range of actors in Europe and beyond to explain the impact of the creation of the European Communities on the international system and how the EU is perceived in the world. The book further shows the significance of the institutional interplay within the EU, and between EU institutions, member states and external actors led by their own internal dynamics to explain policy outcomes. It investigates to what extent the perceptions of the international community towards the European Communities and the EU have been influenced by the complexity of their decision-making and the difficulty of reconciling the views of member states on key external relations issues. The authors also study the interplay of non-EU countries and the EU within the broader context of international and regional institutions and forums for international cooperation.

Transcultural Dictionary of Misunderstandings. European and Chinese Horizons

The Transcultural Dictionary of Misunderstandings. European and Chinese Horizons is the result of an initiative which forges a radically new path for promoting transcultural understanding by studying culture-bound keywords. The stimulating idea is to create and address with intention that which is generally held to be by all means avoided : namely, misunderstandings. The experiment starts with a level of communication that is not political per se but cultural. Cultures have no rigid borders like nation-states. They are more dynamic and meandering, open to influence, and translatable. Like cultures themselves, keywords are saturated with history, long-term experience, values, and collective emotions. They carry a load of tacit knowledge and implicit axioms that have the advantage of not having to be unpacked, explained, or spelled out. Working through various semantic layers of keywords on both sides helps to create a more transparent language for transcultural dialogue. The creation of such a language is the effect of producing, exchanging, and working through misunderstandings on both sides. Within the framework of transcultural dialogue, misunderstandings turn out to be an innovative tool for mutual learning by seeing oneself through the eyes of the other. It is high time for researchers in various parts of the world to join forces and translate basic concepts from one language and culture into another. Every translation is a transformation, marking similarities and differences which can lead to an uncovering of new ideas, values, and cultural practices. This unconventional dialogue is a great source of inspiration because it works through hardened assumptions and misrepresentations, unsettles schematic thinking, and leads to unexpected insights and new points of contact. The monograph presents the results of an international research effort aimed at the analysis of macroeconomic aspects of joining the European Union by the Central European countries. This analysis was based on country and world economy models and rests on a series of alternative scenarios of economic development up to the year 2010. It provides the reader with a broad historical background and a discussion of recent trends of Central Europe. It summarises the experience of the new members of the European Union. The scenario simulations show the likely path of future economic development for the Czech Republic, Poland and Slovakia, analysing the pros and contras of joining the European Union.

The gay's and lesbians's rights in an enlarged European Union

During the last few years, gay and lesbian rights have reached the European Union human rights agenda and different instruments to combat discrimination have been adopted, which have had major implications for the gay and lesbian communities all over Europe, This volume focuses on less known and less studied aspects of these accomplishments. Its originality lies both in the multidisciplinary nature and the international approach of this project ; researchers from different universities throughout Europe (Brussels, Leiden, Stockholm, Athens, Ljubljana, Budapest, Bucharest, Paris and Krakow) and from different disciplines (law, political science, sociology and journalism) have contributed to this volume. Through case studies and theoretical reflection, the articles collected here aim at reinforcing the existing interest for the topic as well as offering an academic look at the subject, with a view to fostering scientific dialogue and contributing to the development of this field of research. The book is structured in three different parts, covering a broad spectrum of issues, among which : legal achievements on outlawing discrimination on sexual orientation within the European Union, the evolution of same-sex partnership and marriage, the accomplishments in the candidate countries. By providing a comprehensive overview of the aforementioned topics, this book can be appreciated by different categories of readers, from those interested in human rights to those working in the specific field of non-discrimination or studying the evolution of norms.

Les juges européens face aux migrations / The European judges faced with migrations

Indigenization of Language in the African Francophone Novel

Indigenization of Language in the African Francophone Novel : A New Literary Canon discusses the question of indigenization in the African Francophone novel. Analyzing the prose narratives of Nazi Boni, Ahmadou Kourouma, and Patrice Nganang, this book contends that African literature written in European languages is primarily a creative translation process. Recourse to European languages as a medium of expressing African imagination, worldview, and cultures in fictional writing poses problems of intelligibility. Developed to express and reflect Western worldviews and sensibilities, European languages are employed by African writers to convey messages that seem to be at variance with European imagination. These writers find themselves writing in languages they wish to subvert through the technique of literary indigenization. The significance of this study resides in its raising awareness to the hurdles that literary creativity in a polyglossic context may present to readers and translators. This book provides answers to intriguing questions centering on the problematic of translation in contemporary African literature. It is a contribution to current research aimed at unraveling the conundrum surrounding the language question in African Europhone fiction, particularly the cultural functions of translation in literature. Potential translation problems have to be addressed in order to make African literature written in European languages intelligible to global readership. With the advent of globalization, transcultural communication has become an activity of enormous importance to the international community. It is a subject of great interest to translators, linguists, language instructors, and literary theorists.

Intra-Group Arrangements under Articles 85 and 86 of the Treaty Establishing the European Economic Community

The theory of enterprise unity is of particular importance to multinational enterprises with many affiliates. The law pertaining to the relationship of the various entities within such a group has to address itself to a whole array of problems. The comparison of the approaches taken by the legal systems surveyed is concerned with the antitrust perspective as discernible from the enforcement practice. The possible application of the Competition Rules to such intra-group arrangements involves an examination of conspiratorial situations in which corporate personnel, agents, unincorporated divisions and incorporated subsidiaries as well as corporations owned by the same person(s) take part.

Lobbyst. Revelations from the EU Labyrinth, 2e édition

I feel the need to enlighten the public on the way the European Union functions, or rather malfunctions. For most readers, this could come as a great shock : how can one imagine that the legislator no longer legislates and that he delegates his legislative power to obscure cenacles called "trilogues" ? Today, being a lobbyist is considered to be bad. A defender of business, of multinationals, of capitalism, ... and by extension of pesticides, intensive agriculture and junk food. That is the image ! The aim of this book is not to correct this image, but to provide elements of appreciation and to give a form of objectivity to the debate. Daniel Guéguen is the longest serving EU lobbyist. He is the former head of the European sugar lobby and then of the European farmers unions. Now a consultant, he is at the heart of the lobbying issues that make the news. Longtime professor in the United States, notably at Georgetown and Harvard. Now at the College of Europe. Multi-author, editorialist, blogger, Daniel Guéguen remains a convinced pro-European, but fiercely critical of an opaque, bureaucratic and, to put it bluntly, anti-democratic system.
